Before registering a new Sydney Airport Message Board user account, or modifying an existing Board account, or posting to the Board, or accessing or using the Board in any way, You must agree to the following Conditions Of Use:

The Board/Us/We - The Sydney Airport Message Board service at http://yssyforum.net and its Moderators
You - a registered or non-registered user of the Board
Moderators - Moderators of the Board, being Kurt Ams, David Knudsen, Justin Lazaroff and Nathan Long. .
Message - any post, topic, attachment or information (in posts, profiles, email addresses and the like) originated by You on the Board.

2.1 You agree to provide Your Real Name as Your Board username in one of two formats:

Either:
First name plus last name (eg. 'John Smith') or;
First name plus last initial (eg. 'John S.' or 'John S').

Exemptions will only be granted by a Moderator in exceptional circumstances. Requests for exemption from this requirement should be forwarded to a Moderator.

2.2 You agree to provide Your current email address, and one on which You are readily contactable in the event that a Moderator should need to contact you. Should your email address change during the course of Your Board use, you agree to update your supplied email address prior to further posting.

2.3 You agree that You will not register or hold more than one user account on the Board.

3.1 You agree that You will not post, in any Message originated by You on the Board, obscene, vulgar, malicious, slanderous, indecent, defamatory or maliciously provocative material (whether text, data, information or otherwise), or material that could give rise to criminal or civil proceedings.

3.1.1 You agree not to post, in any Message originated by You on the Board, Messages un-neccessarily referring to race, sexuality, politics or culture.

3.1.2 You agree to respect the views, beliefs, opinions and ideas of other Board users in Messages originated by You.

3.1.3 You agree that You will not post, in any Message originated by You on the Board, illegal or privileged information, or information pertaining to, or condoning illegal activities (including, but not limited to the collection of aircraft safety cards and equipment), or Web links to such information.

3.2 You agree that You are completely and solely responsible for the content of Messages originated by You on the Board, and acknowledge that neither the Board nor its Moderators will be held liable for the consequences of any Message or attachment originated by You.

3.3 You agree that You will not originate Messages on the Board containing copyrighted material without the express consent and agreement of the party holding the copyright on that material. Where permission has been granted, or where the reproduction and/or distribution of this material is permitted under the Copyright Act 1968 (Commonwealth), the following conditions must be satisfied when using the material on the Board:

- The source of the material is acknowledged, including details of author, artist or creator as required; and
- Any additional requirements on the part of the copyright holder are met; and
- The requirements of the Copyright Act 1968 (Commonwealth) are met.

3.4 You agree that You will not originate any Message or material on the Board containing advertisements for, or links to businesses and other for-profit organisations, and their websites, products or services, without the express permission of a Moderator.

3.4.1 Paragraph 3.4 applies also to the inclusion of advertising or corporate slogans, logos or other messages condoning or advertising any airline or air service organisation, in user signatures or otherwise.

3.5 You agree that You will not originate any Message, topic or material on the Board containing links to personal or not-for-profit organisation websites belonging to, staffed or managed by You, unless a reciprocal link to the 'Sydney Airport Message Board' (at http://yssyforum.net ) is placed on the linked page.

4.0.1 You acknowledge that the Board is a moderated service.

4.1 You acknowledge and agree that the Moderators, as providers of the Board service, reserve any and all rights to censor, block, edit, delete, re-position or otherwise alter Messages originated by You on the Board, without notice to You, at any time.

4.2 You acknowledge and agree that the Moderators, as providers of the Board service, reserve any and all rights to remove, suspend, ban, deactivate or otherwise alter the status of Your user account, without notice to You, at any time.

4.3 You acknowledge that while every effort is made by the Moderators to ensure that all Board posts satisfy these Conditions Of Use, there may be some delay in attending to an alleged breach of these Conditions Of Use.

4.4 You acknowledge and agree that the Moderators reserve the right to vary any or all parts of these Conditions Of Use, at any time.

4.5 You acknowledge and agree that the Moderators reserve the right to apply additional Conditions to Your use of the Board, at any time.

4.5.1 You acknowledge that the Moderators may publish additional requirements and Conditions of Use, from time to time, in the form of 'guidelines' posted to the Board, or to You via email or otherwise. You agree to interpret and adhere to these 'guidelines' as additional Conditions Of Use, and to comply with the requirements of Paragraph 8.2 should You be unable or unwilling to comply with them.

4.6 You acknowledge and agree that the Moderators reserve the right to exempt You from some or all parts of these Conditions Of Use.

5.1 You agree that while using the Board, you will not:

(i) use another person's name, username or password or otherwise attempt to gain access to the account of any other Board user;
(ii) tamper with, hinder the operation of or make unauthorised modifications to any component of the Board service; or attempt any of the above acts or permit another person to do any of the above;
(iii) place any viruses or other similar programs on the Board, in attachments or otherwise; or
(iv) do anything, including send or distribute material or Messages on the Board which interferes with other users or restricts any person or which inhibits any other user from enjoying the Board.

6.0.1 ALL BOARD MATERIALS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON INFRINGEMENT.

6.0.2 Messages and other material appearing on the Board could include technical or other mistakes or inaccuracies. The Sydney Airport Message Board disclaims all warranties and makes no representations regarding the quality, accuracy, completeness or suitability of the Messages or material on this or any other Web site, and disclaims any duty to keep this information current or accurate.

6.1 You use the Board service at Your own risk. You acknowledge that We cannot be held responsible for any loss incurred by You as a result of Your using the Board service.

6.2 You agree to indemnify and hold harmless The Sydney Airport Message Board and its Moderators against all liability, cost, loss or damages arising out of:

(i) the use or attempted use by any person of the Sydney Airport Message Board service.
(ii) any publication including but not limited to the reproduction, broadcast, use, transmission, communication or making available of any material (including data and information of any sort) by You using the Sydney Airport Message Board service.
(iii) any alleged breach of a person's rights or defamation of a person involving the use of the Sydney Airport Message Board service.

6.3 If You breach these Conditions Of Use You are liable to Us for the costs (including all legal costs) in exercising Our rights in relation to the breach.

7.1 IN NO EVENT WILL THE SYDNEY AIRPORT MESSAGE BOARD BE LIABLE FOR ANY DAMAGE WHATSOEVER (INCLUDING WITHOUT LIMITATION DAMAGES RELATING TO LOST REVENUES OR PROFITS, LOST DATA, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION) RESULTING FROM OR IN ANY WAY RELATED TO THE USE OF ANY MATERIALS POSTED ON OR MADE AVAILABLE AT THIS WEB SITE OR ANY OTHER WEB SITE TO WHICH A LINK IS PROVIDED OR ON WHICH A LINK IS PROVIDED TO THIS WEB SITE, EVEN IF THE SYDNEY AIRPORT MESSAGE BOARD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE LEGAL THEORY ON WHICH SUCH DAMAGES ARE BASED.

8.1.1 In using the Board in the ways specified in Paragraph 8.1 after changes to these Conditions Of Use have been implemented, You signify that you have read, understood and accepted the revised Conditions Of Use.

8.2 If You choose not to accept these Conditions Of Use, You must notify a Moderator immediately, and request that Your account be deactivated and/or removed, and You must immediately cease to use the Board in any way specified in Paragraph 8.1 .
